Supreme Court overturns contempt ruling against Akwatia MP

The Supreme Court of Ghana has overturned a contempt ruling previously issued by the Koforidua High Court against the Member of Parliament (MP) for Akwatia, Hon. Ernest Kumi.

In a 4-1 majority decision delivered on Wednesday, the apex court quashed the ruling, effectively clearing Mr. Kumi of all legal sanctions related to the case. The court further directed that High Court Judge Justice Emmanuel Senyo Amedahe be barred from proceeding with any sentencing, stating that the original contempt ruling lacked a proper legal basis.

“Everything has been quashed. He is a free man,” Mr. Kumi’s lawyer told reporters outside the court shortly after the decision was announced.

The contempt charges against the Akwatia MP stemmed from his participation in the parliamentary swearing-in ceremony, despite an injunction from the Koforidua High Court that was yet to be resolved. The court had viewed his actions as a sign of disrespect, leading to the initial contempt ruling.

Mr. Kumi’s legal counsel, Lawyer Kwame Owiredu, welcomed the Supreme Court’s decision, calling it a victory for justice.

“Justice has finally prevailed,” he said. “We maintained from the outset that the contempt charges were misplaced, and we’re grateful that the Supreme Court has affirmed our position.”

With the decision now final, Hon. Ernest Kumi is free to continue his duties as MP for Akwatia without any legal impediment.
