Court Dismisses NPP’s Nana Akua Afriyie’s Injunction Against Ablekuma North Rerun

The High Court has dismissed an injunction application filed by Nana Akua Afriyie, the NPP’s 2024 parliamentary candidate for Ablekuma North, seeking to stop the Electoral Commission from conducting a rerun in 19 polling stations on July 11.

Justice Ali Baba Abature ruled the application as “unmeritorious,” stressing that the EC’s constitutional mandate to ensure representation outweighed the candidate’s objections.

Afriyie’s lawyers argued that the EC was defying a January 4 court order directing it to collate and declare results from 62 polling stations, noting that the Commission had itself stated only three were left uncollated. They described the rerun as unlawful and in contempt of court.

But the court held that Afriyie failed to prove the EC could legally declare results without further verification. The judge said any challenges to the EC’s actions should be resolved through substantive legal processes — not by halting the rerun.

He concluded the EC could compensate Afriyie with damages if she later prevails.
